Oklahoma Lien Deadlines

Preliminary Notice

75 days after completion of work

You must provide a "Pre-Lien Notice" to both the property owner and the general contractor within 75 days of the last date you furnished labor or materials to an owner-occupied residential project (1-4 dwellings) and for commercial jobs where the total claim is over $10,000. Not required on: - New residential developments that are not owner occupied - Owner-occupied residential projects (5+ dwellings) - Commercial jobs less than a total claim value of $10,000.

Mechanic's lien

90 days

Must be filed within 90 days of last work. Once the lien is filed, a copy of the lien statement must be sent by the claimant to the property owner via certified mail within 5 business days. Enforcement must be initiated within 1 year from the date of lien recording.

Preliminary Notice & Notice of Intent

Preliminary Notice: On an owner-occupied residential property, the general contractor is required to provide a specific "Notice to Owner." For all other projects, general contractors are not required to provide a preliminary notice to preserve their lien rights. Subcontractors and suppliers must provide a "Pre-Lien Notice" unless: -The project is not an owner-occupied residential dwelling, and the total claim is less than $10,000. -The project is a new residential development that is not owner-occupied. Notice of Intent to Lien: Not required in Oklahoma.

Oklahoma Public Works

In Oklahoma, a mechanic's lien on public works projects is not available. Subcontractors and suppliers can file suit on a payment bond. For subcontractors and suppliers without a direct contract with the general contractor, a notice must be sent within 90 days of last work. Suit must be filed within 1 year of last work.
