New Mexico Lien Deadlines
Preliminary Notice
60 daysPreliminary notice is required within 60 days of starting work if the claimant does not contract directly with the property owner or general contractor, the claim exceeds $5,000, and the project is not on a residential property with fewer than four dwellings. If preliminary notice is late, it will only cover the work or materials provided within the 30 days immediately prior to the date the notice was sent.
Mechanic's lien
90-120 daysMust be filed within 90 days of project completion. Deadline is extended to 120 days if directly contracted with the project owner. Enforcement must be initiated within 2 years of lien filing. Mechanic's liens cannot be extended in New Mexico.

New Mexico Public Works
In New Mexico, a mechanic's lien on public works projects is not available. Parties who provided labor or materials under the original contract or subcontract are able to file suit on a payment bond for contracts over a certain dollar threshold. If not under direct contract with the general contractor, notice must be given within 90 days of last work. Suit must be filed within 1 year of the owner and general contractor settling the contract
