Nebraska Lien Deadlines

Preliminary Notice

Not required, but highly recommended before work begins.

A "Notice of Right to Assert Lien" can be sent after entering into an agreement and before work begins. The benefit is it preserves a larger "unpaid balance" on the general contract, giving your future lien claim a greater chance of being secured for the full amount you are owed, rather than only the unpaid balance owed to the party you contracted with.

Notice of Intent

Not required

Recommended to send a Notice of Nonpayment 10-30 days prior to filing the lien.

Mechanic's lien

120 days

Must be filed within 120 days of last work. Enforcement must be initiated within 2 years of lien filing. However, the project owner can shorten this deadline to 30 days by written demand. Mechanic's liens cannot be extended in Nebraska.

Nebraska Public Works

In Nebraska, a mechanic's lien on public works projects is not available. Subcontractors and suppliers can file suit on a payment bond. The bond cannot be less than the contract value except for certain state and local projects below a certain dollar threshold. Parties that do not have a direct contractual relationship with the contractor must give written notice within 4 months of last work. Suit must be filed within 1 year of final settlement of the general contract (if claimant unpaid within 90 days of last performance).
