Preliminary Notice & Notice of Intent

Preliminary Notice: General contractors must provide a Disclosure Notice to Owner. For subcontractors and suppliers, best practice is to serve a Notice to Owner (not required). Equipment rental companies MUST serve a Notice to Owner within 15 days of the equipment being used on the project. Notice of Intent to Lien: Required for subcontractors and suppliers not hired directly by the project owner.

Who Can File a Mechanic's Lien

Contractors, subcontractors, suppliers, architects, and engineers are entitled to mechanic's lien rights in Missouri.

Who Gets the Notice

Notice is given to the project owner, the general contractor, and any lender.

Missouri Public Works

In Missouri, a mechanic's lien on public works projects is not available. Subcontractors and suppliers can file suit on a payment bond for certain public works contracts greater than $50,000. There are no notice requirements except for "remote suppliers." Suit must be filed within 10 years.
