Preliminary Notice: Not required in Idaho. The exception is that residential projects greater than $2,000 require the general contractor to provide a Residential Disclosure Notice. Notice of Intent to Lien: Not required in Idaho, but can be sent to help secure payment.

Idaho Public Works

In Idaho, a mechanic's lien on public works projects is not available. Parties working on public contracts greater than or equal to $50,000 are able to file suit on a payment bond. Parties without an express or implied contractual relationship must give notice more than 90 days but less than 1 year after the claimant last furnished labor or materials. Suits must be filed within 1 year of last work (within 1 year of the date that final payment was due for subcontractors).
