Preliminary Notice

Mechanic's lien

Must be filed within 120 days of last work. Enforcement must be initiated within 15 months of lien filing. Mechanic's liens cannot be extended in Arkansas.

Preliminary Notice & Notice of Intent

Arkansas Public Works

In Arkansas, a mechanic's lien on public works projects is not available. Subcontractors and suppliers can file suit on a payment bond provided by the contractor, except for contracts by the Arkansas State Highway and Transportation Department, which are exempt. For public work contracts of $20,000 or more, a bond equal to the contract price is required. Religious or charitable organization contracts over $1,000 must also be bonded. Claimants must file suit within six months of project completion for religious/charitable organization contracts, or within 12 months of final payment approval on all other public projects.
